The European Union Deforestation Regulation (EUDR) was enacted in the context of rapidly increasing global deforestation and forest degradation, driven primarily by agricultural expansion, including commodities consumed in the EU. To minimize the impact of EU consumption on forest resources, the EU implemented the EUDR, requiring that products across 7 key commodities entering the EU market must comply with and prove they are not linked to deforestation or forest degradation throughout the entire supply chain.

SCOPE OF APPLICATION
The EUDR applies to 7 key commodities with a high risk of driving deforestation (including derivative products such as paper, furniture, chocolate, etc.).




EFFECTIVE DATE AND IMPLEMENTATION
Regulation (EU) 2023/1115 of the European Parliament and of the Council, issued on May 31, 2023, aims to prevent the consumption of products associated with deforestation and forest degradation occurring after December 31, 2020, on the EU market globally.

Vietnamese enterprises do not have to declare directly on the EU system, but they must provide full information and evidencefor the importer's declaration and remain accountable upon request.

WHAT SHOULD SUPPLY CHAIN ACTORS DO?
Enterprises must prepare the following documents:





Note: Records must be kept for at least 5 years and may be audited at any time by the importer, the EU, or a third party.
(1) Land Use Rights Certificate (LURC), Land Allocation Decision under Decree 02/CP, Contracting Agreement under Decree 01/CP or 168/2016/ND-CP, Forest Land Lease Agreement with other organizations/individuals, Land Lease, Factory Lease, Business Location Lease, etc., Commitment to Legal Production without disputes confirmed by Commune People's Committee
(2) Point or polygon coordinates for forest/garden plots (rubber) ≤ 4 ha; polygon coordinates for forest/garden plots > 4 ha (mandatory)
